Terms and conditions

1. General

These terms apply to services delivered by VargTech AS. By placing an order you accept them.

2. Services

VargTech AS delivers digital services within:

• Web design
• Web applications
• UI/UX Design
• Landing Pages
• Backend development
• Artificial intelligence and digitalisation
• Penetration testing & cybersecurity
• Optimisation & maintenance
• Hosting & operations agreement

Scope and delivery are clarified and agreed separately for each individual assignment.

3. Prices and payment

All prices are stated excluding value added tax (mva) unless otherwise agreed. Payment terms are set for each individual assignment.

Late payment accrues interest in accordance with the Norwegian Act relating to interest on overdue payments (forsinkelsesrenteloven).

4. Liability and complaints

We carry out assignments to a professional standard. Complaints must be submitted in writing. The deadline is within reasonable time after you discovered, or ought to have discovered, the defect.

Liability covers documentable direct loss caused by our error. We are not liable for indirect loss (such as lost revenue or goodwill), unless mandatory law provides otherwise.

5. Confidentiality

Information in an assignment is treated confidentially. We do not pass on client information to third parties without written consent.

6. Intellectual property rights

Rights to the delivery follow the agreement for the assignment. Without a specific agreement, VargTech AS retains ownership of documentation and general working methods.

7. Artificial intelligence and digitalisation

For assignments concerning AI solutions and digitalisation, the following also applies:

• The solutions may use third-party model services. Which ones are used, and what is sent to them, is agreed specifically for each assignment.
• You are informed about which data is processed by such services, and we enter into a data processing agreement where this is required.
• AI-generated results may contain errors. You are responsible for quality-assuring the results before they are used in decisions.
• Rights to what is produced are agreed in the assignment agreement, cf. section 6.

8. Termination

Ongoing assignments may be terminated in writing. You pay for work carried out up to the time of termination.

9. Disputes

Disputes shall be sought resolved amicably. If the matter is not resolved, Norwegian law applies. Legal venue follows the rules of the Norwegian Dispute Act (tvisteloven).

10. Changes

VargTech AS reserves the right to change these terms. Changes are announced on our website and apply to new assignments.
